Julia remarried after William's death to Charles Gomer JENKINS

at St Augustine's Church in Napier a few weeks before he left to serve in WW1 where he ultimately was killed in action on 17 January 1918.  He was born c1881.

First husband William charged with bigamy

William Brown was placed at the bar, charged with having, on the 12th May last, at Christchurch, contracted marriage with one Jane Porter, his wife, Mary Ann Pawson (to whom he was married at Akaroa, on the 14th February, 1865) being still alive.

The prisoner pleaded "Not Guilty."

Mr Duncan prosecuted on the part of the Crown; and Mr Wynn Williams appeared for the defence.

Mr Frederick William Thiel was chosen foreman of the jury.

Mr Duncan having stated the case for the Crown, called the following evidence:

Michael Flannagan: I was at one time a constable, stationed at Akaroa. I arrested the prisoner about the 2nd June last, on a charge of bigamy. I read the warrant to him, and cautioned him in the usual manner. He said, "They might let people live in peace when they're trying to. I thought I was doing it for the refuge of poor orphans who were kicked about by everybody."

Cross-examined by Mr Williams: I have been very nearly three years at Akaroa. Mr Duncan put in the certificate of the officiating minister of the marriage of one Wm. Brown with Mary Ann Pawson, at Akaroa, on the 14th February, 1865, by the Rev Wm. Aylmer. Mr Williams objected to the certificate being put in. Mr Duncan would first of all have to prove that Mr Aylmer was the officiating minister. Mr Duncan said he could prove it. Mr Williams said the certificate might be admitted, subject to proof that Mr Aylmer was the officiating minister.

William Kearney: I am a labourer, residing at Le Bon's Bay. I know the prisoner. About February, 1865, I remember his calling on me opposite the Courthouse, Akaroa, to witness his marriage to Mary Ann Pawson. I went with him to the English Church in Akaroa. He was married there to Mary Ann Pawson by the Rev Wm. Aylmer. Tom Pawson, her brother, was also present. I signed my name as a witness in the register.

Cross examined by Mr William: I have lived about Akaroa and the Bays ever since the marriage. At the time of the marriage, I knew Mary Ann Pawson and her brother. I don't remember ever seeing her after her marriage. At Akaroa, I saw a person the other day whom they said was her, but I was not sure it was. I heard about Mary Ann Pawson after she was married. I heard she had left the prisoner.

Thomas Pawson: l am a saw-mill proprietor on the Peninsula. I know the prisoner. I was present at his marriage with my sister, Mary Ann Pawson, at the English Church, Akaroa, on the 14th February, 1865, by the , Rev Mr Aylmer. They lived together as man and wife for some time. It is about six years and a half since they parted. They lived as man and wife at the head of Akaroa Bay until six and a half years ago. I don't know whether they have met since. My sister is still t alive. She is in Court. I couldn't say when she and prisoner last met. A little while after they were married, the prisoner left and went to the West Coast, leaving his wife behind. He was absent three or four months. He returned, and they lived together after his return. It is fire years last June since I left Akaroa. My sister was then living in German Bay, as servant, at Mr O'Brien's. Brown was living somewhere in the neighbourhood of Akaroa. I used to see him occasionally in the neighbourhood of Akaroa.

Cross-examined by Mr Williams : I have no idea how soon after the marriage the prisoner went to the West Coast. It was within the 12 months after he married that he went. I will not swear it was not within six months after he was married. I will not swear it was not within three months after he was married. I did not go to fetch prisoner's wife away with a dray. I was present when she left the prisoner. I couldn't say whether she ever returned. I did not go intentionally to fetch her away. I don't think O'Keefe was about the place when she left. I believe I carried a bundle for her. She walked away. I walked with her. There was a sledge there a few days previous. I took it there. I don't recollect the sledge being taken away the day she left. There were some boxes on the sledge. After that, my sister lived at O'Brien's. She had not a child during the time she was at O'Brien's. I don't know whether she has children now. She never spoke to me about it. She did not tell me she had been married since he had been at the West Coast.

Jane Porter deposed: I have been living in Akaroa since 1868. I was a widow since. I have since
been married. I was married on the 12th of May last to William Brown, the prisoner. I did not know that he had been married. I did hear that there was such a family as the Pawsons. I did not know that there was one on the West Coast. I had no conversation with the prisoner about the Pawsons, except in the way of business. He never informed me that he had been married before I have been acquainted with him (the prisoner) for nearly four years. I was left a widow with six helpless children on the roadside to perish, and, through the influence of Mr and Mrs Glenning, the prisoner was induced to allow me to live in a part of his house, which belonged to Mr Glenning.

Cross-examined by Mr Williams: I did not take these proceedings against the prisoner. When I was left destitute, the prisoner assisted to provide for my children.

Burrel Parkerson gave evidence as to the marriage of the prisoner with Jane Porter on the 12th May last.

This was the case for the Crown. Mr Williams addressed the jury; and his Honor having summed up, the jury returned a verdict of "Not guilty
